Careless/Reckless Driving

It Isn't Just A Traffic Ticket! You Could Face Jail Time!

Simply because careless and reckless driving are considered traffic violations, it does not mean that you should take them lightly. Did you know that you could face a 60-day jail sentence for your first reckless driving offense? If you have a prior offense on your record, the possible penalties only increase.

"The bottom line is Tom dots his i's and crosses his t's ... Do yourself a big favor, stop looking. You've found the lawyer who will guard your freedom in the most professional way possible." - Jim, a former client

Dangerously Broad Definitions For A Serious Offense

Arguably one of the most troubling aspects of these cases is that the definition of each offense is based on the subjective view of the officer. The truth is that almost anything could fit under either of the two extremely broad definitions.

Under New Jersey law:

  • Careless driving is defined as "driving carelessly without due caution" in such a way that it is likely to endanger person or property. It is a two-point offense.
  • Reckless driving is defined as driving a vehicle "heedlessly, in willful or wanton disregard of the rights or safety of others" in such a way that does or could endanger person or property. It is a five-point offense. A first offense is punishable with 60 days in jail and/or a fine. A subsequent offense is punishable with three months in jail and/or a fine.

"Received a reckless driving and speeding for 100 in a 65. Due to my work schedule, Mr. Blauvelt and his staff were able to execute a rather quick court date appearance on short notice. He is very familiar with the courts' procedure and personnel, due to his 20 years of experience. Reckless driving was dismissed.

Mr. Blauvelt personally responded to email inquiries in a very efficient manner. I received a response at 10 p.m.; he simply went above and beyond. Very grateful to have his representation." - A former client
